Free Update: New Trade Union Rights – Are you prepared?

The Employment Rights Act 2025 introduces some of the most significant changes to trade union law in recent years, increasing legal and operational risks for all employers including those that don’t recognise trade unions.

Several key trade union reforms have already come into force, with further important changes due to take effect over the coming months. We will provide an overview of the changes introduced so far before focusing on key developments employers should be preparing for now: trade union right of access and the duty to inform workers of their right to join a trade union.

On 30 October 2026, trade union right of access will be strengthened significantly. Reforms introduced by the Employment Rights Act 2025 give trade unions the right to seek access to all employers with 21 or more workers. With strict deadlines, employers risk imposed terms and substantial financial penalties if they fail to prepare.

From January 2027, employers will be required to inform all new workers of their right to join a trade union. We will discuss the various methods of delivery available to employers to communicate the right compliantly.
