How to Conduct Employment Investigations

Register

We are running a webinar on how to conduct employment investigations in the workplace from 10 am – 12 noon on Thursday 13th January 2022.

An employer’s decision regarding an employee often comes down to the investigation followed. Carrying out a sufficient, fair and proper investigation is fundamental to the overall fairness of a potential sanction an employee may receive and in ensuring a fair internal process is followed. By choosing an appropriate investigator and following a proper process is essential in establishing the facts and advising on the appropriate next course of action to take.

More often than not, investigations can expose an employer at tribunal because, for instance they are inadequate, one sided or don’t go far enough to uncover all the facts. Recently Sainsbury’s has been criticised by the Employment Tribunal for a shambolic investigation at every stage of an internal process therefore employers, regardless of size, are not immune to the risks of an inadequate investigation.

Here are some key points the session will cover:

  • Legal background
  • When to carry out an investigation
  • The role of the investigator
  • Process of the investigation (fact finding, interviewing witnesses, obtaining statements and concluding the investigation – drafting the report)
  • Common issues that arise
  • Suspension?

There will be an opportunity to ask questions of our employment lawyers and raise any concerns you may have.

The session will be delivered by expert employment and equality lawyers from Collingwood Legal – an award winning employment law firm, recognised as a Top Tier employment law firm by the UK Legal 500, based in Newcastle upon Tyne.
